TERMS AND CONDITIONS

 

Introduction

Thank you for your interest in one of the online or in person School of Sustainable Floristry Workshops, Classes and Courses (each, a Workshop). Should you choose to book a Workshop, these terms and conditions (the Conditions) shall apply and shall be deemed accepted from the point of full or partial payment onwards.

Workshops are hosted and run by the School of Sustainable Floristry. For any questions regarding the Workshops or your booking, which cannot be found below, please contact cissy@schoolofsustainablefloristry.co.uk.

 

1.             Workshops

1.1           Course Content. Workshops shall be run in accordance with the details published by us, including on our website or marketing materials. Please note that any images or descriptions are published to give an approximate idea of the services provided but we reserve the right to change flowers, materials or content, in our discretion, including for reasons of seasonality, supply chain issues and cost.  

1.2           Health & Safety. At the beginning of each in-person Workshop, students will be informed of the Health and Safety policies of the venue and on occasion, you may need to sign an additional waiver. You must comply at all times with any such policies.

1.3           Your Photography. Students are welcome to take photographs for personal use during the Workshop. Please ask permission before taking images of other students’ work, other students or the teachers. Please credit the Workshop attended if using images online.

1.4           Filming. We do not allow videos to be taken during Workshops.

1.5           Our Photography.  From time to time, we may take photographs during Workshops and we reserve the right to use these for our own purposes, including for marketing on our website and social media channels. If you would prefer not to be included in such any photographs, kindly notify us in writing before the start of the Workshop.

1.6           Personal Belongings. We do not accept liability for any loss or damage to personal belongings left at or in the vicinity of our Workshops, including items left in vehicles parked at our venues. Students must accept full responsibility for storing personal possessions at any of our Workshops and for removing them at the end of the day.

1.7           Course Materials. All materials shared with you before, during or after the Workshop should not be shared or published with any third party and should remain confidential at all times.

 

2.             Bookings & Payment

2.1          How to book. Workshops can be booked directly via our website – www.schoolofsustainablefloristry.co.uk - using the third party payment provider or over email, with payment via BACs.

2.2          Reservation of space. Full payment or the full deposit (as stated on each individual Workshop description), must be received in full at the time of booking and place cannot be guaranteed until these have been received. If you do not pay in full before the Workshop (where required) we reserve the right to offer your space to our waitlist.

2.3          Non-refundable. All Workshop fees are non-refundable, please see our cancellation policy below for more details.

2.4          Price increases. We will not increase the price of a Workshop after you have booked, however, we reserve the right to increase our prices each year in line with inflation and costs.

 

3.             Cancellation

3.1          Cancellation by you. As a small business, we have a strict no-refund policy on Workshop places and deposits. This includes cancellations due to illness, travel, personal or professional reasons. At our discretion and if circumstances allow, we may be able to offer students transferral to an alternative Workshop. We strongly recommend that you take out insurance against loss in the event of your being unable to attend the Workshop due to unforeseen circumstances.

3.2          Cancellation by us. We reserve the right to amend, reschedule or cancel Workshops and will endeavour to provide students with as much notice as possible should this occur. We will try to avoid cancelling Workshops if at all possible, however, in certain circumstances this may be unavoidable.  In the unlikely event of a workshop being cancelled by us, students will be given the option of a full refund or the transferral of their place to an alternative date. Please note that we have a minimum number of students required in order to run any of our Workshops, and if the minimum is not met we may be required to cancel or rearrange such Workshops.

3.3          No liability for cancellation costs. We are not liable for any losses (including but not limited to travel and accommodation arrangements) that could arise as a result of a Workshop being cancelled.

3.4          Transfer of space(s). You are entitled to transfer your space to a friend or third party, providing you notify us in advance. We shall not be responsible for payment or reimbursement, and you shall ensure that these Conditions are properly communicated to such friend or third party in advance of the Workshop.

 

4.             Personal Data

You may provide certain personal data to us in the course of booking, paying for and attending a Workshop. We shall protect such personal data in accordance with our privacy policy, which can be found here.

 

5.             Intellectual property rights

All intellectual property rights in or arising out of or in connection with the Workshops shall be owned by us, including any designs, course materials, photographs or other content taken by us at each event.

 

6.             Limitation of Liability

6.1          Nothing in this contract limits any liability which cannot legally be limited.

6.2          Subject to clause 6.1, our total liability to you or any Workshop student to whom you may transfer your space, shall be limited to the fees paid to us in relation to the relevant Workshop.

6.3          We shall not, under any circumstances, be liable for any indirect, special or consequential loss, cost or damage arising from this contract or our dealings with you. We shall not be liable for any of the following direct losses: (i) loss of or damage to your own personal property; (ii) accident, injury or physical reaction at or after one of our Workshops which was caused by anything other than our own deliberate fault or material negligence; (iii) any third party use of any content we share to our website or social media channels; or (iv) the success/failure of any business or venture arising out of a Workshop.

6.4          The terms implied by sections 3, 4 and 5 of the Supply of Goods and Services Act 1982 are, to the fullest extent permitted by law, excluded from the contract between us under these Conditions.

6.5          Unless you notify us that you intend to make a claim in respect of a Workshop within 30 days of it finishing, we shall have no liability for that Workshop. The notice must be in writing and must identify the event and the grounds for the claim in reasonable detail.

 

7.           General

a.     Force majeure. We shall not be in breach of these Conditions nor liable for delay in performing, or failure to perform, any of our obligations under the contract (including hosting a Workshop) if such delay or failure result from events, circumstances or causes beyond our reasonable control.  These shall include (without limitation) acts of God, terrorism, accident, war or conflict, lockout, strikes, flood, fire, power or water failure, delay in transit, obstruction of access, pandemic or epidemic and any other unprecedented or unexpected impact on the UK floristry market.

b.    Confidentiality. You agree to keep our prices, course materials, non-public content and any other confidential or sensitive material confidential at all times. This shall survive expiry of the contract between us.

c.     Entire agreement. These Conditions constitutes the entire agreement between the parties and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.

d.    Variation. Except as set out in these Conditions, no variation of the contract between us shall be effective unless it is in writing and signed by both parties.

e.     Third party rights. No third party has any rights under these Conditions.

f.      Governing law. The contract between us is governed by the law of England and Wales and the English courts shall have exclusive jurisdiction.
